Article 2 – Purpose

These terms govern access to and use of the Website. Purchases on the Website are governed by our Terms of Sale, accessible at the bottom of every page. In the event of a conflict between the two documents, the Terms of Sale take precedence for orders, prices, delivery, withdrawal and guarantees.

Article 3 – Access and customer accounts

The Website is available free of charge to anyone with internet access. Creating a customer account is optional. If you create an account, you undertake to provide accurate, up-to-date information and are responsible for keeping your login details confidential. Notify us immediately of any unauthorised use of your account.

Article 4 – Products and prices

Products are brand-new unless otherwise stated on the product page. Prices are in euros, including all taxes (French VAT included). Any delivery costs are shown before the order is confirmed. Photographs are as accurate as possible; only the written specifications on the product page are binding on the seller.

Article 5 – Orders, delivery and returns

The order process, delivery times and methods, the 14-day right of withdrawal and statutory guarantees are described in our Terms of Sale, shipping policy and returns and refunds policy. You may also drop off a returned product at one of our GSMCLINIQUE stores.

Article 6 – Intellectual property

The Website's own text, layout and graphic elements are the property of SARL GSM CONCEPT and protected by the French Intellectual Property Code. Reproduction or reuse without prior written permission is prohibited. The manufacturers' brands, logos and images cited (Apple, Samsung, Google, etc.) remain the property of their respective owners and are used solely to identify the products sold.

Article 7 – Third-party links and services

The Website may contain links to third-party websites or incorporate third-party services (payment, transport, customer reviews). We do not control these websites and services and are not responsible for their content or practices. Their use is subject to their own terms.

Article 8 – Relationship with Shopify

The Website operates on the Shopify platform. Any sale concluded on the Website is directly between you and SARL GSM CONCEPT. Shopify is not a party to the sale and is not responsible for any aspect of it, including the products or services purchased.

Article 9 – Personal data

Our privacy policy explains how your personal data is processed. You may exercise your rights (access, rectification, erasure, objection) by writing to monmobilemoinscher@gmail.com.

Article 10 – Reviews and user content

If you post a review or comment, it must be truthful, relate to your own experience and contain no unlawful, abusive or defamatory statements. We may remove content that does not comply with these rules.

Article 11 – Prohibited uses

You must not use the Website for unlawful purposes, introduce malicious code, attempt to access non-public parts of the Website, bypass its security measures or overload it through automated means. We may suspend access for a user who does not comply with these rules.

Article 12 – Liability

We endeavour to keep the Website accessible and its information accurate but cannot guarantee uninterrupted or error-free operation. If there is an obvious error on a product page or in a price, we correct it as soon as possible in accordance with the Terms of Sale. Nothing in these terms limits your statutory rights, particularly the statutory guarantee of conformity and guarantee against hidden defects.
