Terms of sale
Terms of Sale
Effective from 29 September 2026.
Article 1 – Purpose and scope
These Terms of Sale govern distance sales of products (mobile phones, tablets and accessories) on www.monmobilemoinscher.com (or www.monmobilemoinscher.fr), referred to as the Website, between the seller identified in Article 2 and any individual acting as a consumer (the Customer). Placing an order entails acceptance of the Terms of Sale in force on the order date, which the Customer acknowledges having read and accepted before confirming the order.
Article 2 – Seller
SARL GSM CONCEPT (trading name GSM - CLINIQUE.COM / GSMCLINIQUE, online trading name MonMobileMoinsCher), a French limited liability company with share capital of €7,500, registered office at 4 avenue Guillabert, 06600 Antibes, France, RCS Antibes 484 146 238, intra-community VAT number FR11484146238.
Customer service: 04 93 65 71 68 – monmobilemoinscher@gmail.com.
Article 3 – Products
Products offered are brand-new unless explicitly stated otherwise on the product page. Their essential characteristics (model, capacity, colour, compatibility and regulatory information such as SAR) appear on each product page. Photographs are as accurate as possible; only the written specifications on the product page are binding on the Seller. Offers remain valid while visible on the Website, subject to available stock.
Article 4 – Prices
Prices are in euros, including all taxes (French VAT included). Any delivery charges are shown before the order is confirmed and added to the total. The applicable price is the price displayed when the order is confirmed. The Seller may change prices at any time, without affecting orders already confirmed.
Article 5 – Orders
The Customer selects products, checks the order details and total price, chooses a delivery method and pays. The order becomes binding after payment confirmation. An email summarising the order is sent to the Customer. The Seller may refuse or cancel an order in the event of an unresolved previous dispute with the Customer, suspected fraud or an obvious pricing error; the Customer is then refunded in full.
Article 6 – Availability
Some products are sourced from our supplier after the order is placed, which is reflected in the stated dispatch times. If, despite our checks, a product proves unavailable after an order, the Customer is promptly informed by email or telephone and may either wait for a new timeframe communicated to them or cancel the order. If cancelled, amounts paid are refunded no later than 14 days after payment.
Article 7 – Payment
Payment is made online when ordering, using the methods offered at checkout through a secure payment provider. The Seller never has access to the Customer's full bank details. The Customer's account is debited when the order is confirmed.
Article 8 – Delivery
Delivery areas, available methods (for example collection point or express) and their prices are shown before the order is confirmed. For mainland France, dispatch takes place within 4 working days for standard delivery and within 2 working days for express where offered; transport time is additional to this dispatch time. Details are provided in our shipping policy.
The risk of loss or damage passes to the Customer when the Customer, or a third party designated by them other than the carrier offered by the Seller, takes physical possession of the products. The Customer should check the parcel on receipt and report any problem to the carrier and customer service as soon as possible.
Where no date is stated, delivery takes place within 30 days of the order. In the event of delay, after requiring the Seller to deliver within an additional reasonable period, the Customer may terminate the contract in writing if delivery has not taken place within that period (Article L216-6 of the French Consumer Code). A refund is then made within 14 days.
Article 9 – Right of withdrawal
The Customer has 14 days from receipt of the product to exercise the right of withdrawal without giving a reason. The arrangements for exercising this right, returning the product (including free drop-off at one of our GSMCLINIQUE stores) and obtaining a refund, together with the model withdrawal form, are set out in our returns and refunds policy, which forms an integral part of these Terms of Sale.
Article 10 – Statutory guarantees
All products benefit from the following statutory guarantees, independently of the right of withdrawal and any commercial warranty:
- Statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): the Customer has 2 years from delivery to invoke the guarantee for a lack of conformity. During this period, the Customer need only establish that the defect exists, not when it appeared. The Customer may choose repair or replacement unless that choice entails a clearly disproportionate cost; failing this, or if conformity cannot be restored, the Customer may obtain a price reduction or terminate the contract for a refund. Repair under the guarantee extends it by 6 months.
- Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may take action within 2 years of discovering the defect and choose cancellation of the sale or a price reduction.
To exercise these guarantees, the Customer should contact customer service (04 93 65 71 68 – monmobilemoinscher@gmail.com). Return costs for a non-conforming product are borne by the Seller.
Article 11 – Customer service and complaints
For questions or complaints, the Customer may call 04 93 65 71 68, email monmobilemoinscher@gmail.com or visit a GSMCLINIQUE store: Antibes (4 avenue Guillabert, 06600), Pau (8 rue Samonzet, 64000) or Lescar (rue de Rebeque, 64230).
Article 12 – Personal data
The Customer's personal data is processed to manage orders and the customer relationship in accordance with our privacy policy, accessible at the bottom of every page of the Website.
Article 13 – Applicable law and disputes
These Terms of Sale are governed by French law. In the event of a dispute, the Customer should first submit a written complaint to customer service to seek an amicable resolution. Failing this, the dispute is brought before the court with jurisdiction under the ordinary rules of law; a consumer Customer may in particular bring proceedings before the court for the place where they lived when the contract was concluded or when the harmful event occurred.
